These Terms of Service ("Terms") govern your access to and use of Cretos, an AI-native operating system that lets creators, businesses, agencies, and builders run AI agents, sell products and services through a storefront, and automate parts of their business ("Service"), operated by AILuminary Intelligence Private Limited, a company incorporated in India, doing business as Cretos ("we," "us," "our"). By creating an account or using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you don't agree, don't use the Service.
You must be at least 18 years old, or the age of legal majority in your jurisdiction, to create an account. If you're using Cretos on behalf of a company or agency, you're confirming you have authority to bind that entity to these Terms.
Cretos gives you access to AI Agents (pre-built and custom agents via Agent Studio that generate content, automate workflows, and act on instructions you configure), a Storefront & Checkout to sell digital products and services, Free Tools available to any user, and Credits & Subscription Plans that meter AI agent usage. We may add, change, or remove features at any time — we'll try to give reasonable notice of material changes that affect your paid plan.
If you sell through the Cretos storefront, we facilitate payment collection from your customers and payout to you, subject to identity/bank verification (KYC), our platform fee (as disclosed on your plan), and applicable payment processor terms. We may withhold or delay payouts to investigate suspected fraud, chargebacks, or violations of these Terms.
You agree not to:
Cretos lets you connect third-party accounts (e.g. YouTube, TikTok, Instagram, LinkedIn, Twitter/X, Twitch, Pinterest) to sync content or power agent workflows. Your use of those platforms remains subject to their own terms. We're not responsible for changes those platforms make that affect functionality here.
Cretos, our logo, and the underlying platform (excluding Your Content and AI-Generated Output as described above) are owned by us or our licensors. Nothing in these Terms transfers our IP to you except the limited rights explicitly granted here.
If you participate in our affiliate program, additional program-specific terms (reward structure, prohibited promotional practices) apply and will be provided at signup for that program.
Businesses can register a brand profile with Cretos to be discovered by, and collaborate with, creators. By submitting a brand registration, you confirm you're authorized to represent that company. The information you provide — company and contact details, business profile, uploaded documents, and collaboration preferences — is reviewed by our team and may be enriched using publicly available information; enriched data is never applied to your profile without confirmation from you or our team. We use this information to verify your profile and match you with relevant creators. Additional brand-partner-specific terms may apply as that program expands.
If you submit an inquiry through our Enterprise "Talk to us" form, you confirm you're authorized to share the business information you provide (name, work email, phone, job title, company, website, industry, team size, and the goals you describe), and you agree we may contact you using those details to discuss your needs and prepare a proposal. Submitting an inquiry, or scheduling a call, does not create a contract, subscription, or fee obligation of any kind — Enterprise engagements, including pricing and scope, are governed exclusively by a separate written agreement signed by both parties.
You can stop using Cretos and request account deletion at any time via Settings → Privacy & Data, by providing a brief reason for the request. Your account is deactivated and you're signed out immediately; we retain your data for 7 days in case you want it restored, after which it is permanently deleted (billing records are kept separately where required by law). We may suspend or terminate your account for violation of these Terms, non-payment, suspected fraud, or legal requirement, with notice where reasonably possible. Sections that by their nature should survive termination (IP, disclaimers, limitation of liability, dispute resolution) will survive.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW. WE DON'T WARRANT THAT AI-GENERATED OUTPUT WILL BE ACCURATE, COMPLETE, OR SUITABLE FOR ANY PARTICULAR PURPOSE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CRETOS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE.
You agree to indemnify and hold Cretos harmless from claims arising out of your use of the Service, your Content, or your violation of these Terms or applicable law.
These Terms are governed by the laws of India. Any dispute arising out of or relating to these Terms or the Service will be subject to the exclusive jurisdiction of the competent courts in India, unless otherwise required by applicable local consumer protection law in your jurisdiction.
We may update these Terms from time to time. If a change is material, we'll notify you (e.g. by email or an in-app notice) before it takes effect. Continued use of the Service after a change takes effect means you accept the updated Terms.
